Pamela Kennedy, 35, was given a six-month restriction of liberty order in December after she struck Martin Cawley, 64, with her car.

The granddad was walking across the road in Glasgow’s Wellhouse when Kennedy hit him and his dog Zoe on February 6 2023.

She claimed that she swerved her red Nissan Micra to avoid hitting Zoe – who was later put down – and did not see Mr Cawley.

Kennedy gave Mr Cawley CPR at the scene and was heard to say: “Don’t do this to me, you have got to live, this will affect my job if you die.”

Bank nurse Kennedy was told to remain in doors between 7pm and 7am after she was found guilty at trial of causing death by careless driving.

She was also ordered to do 300 hours of unpaid work and disqualified from driving for 18 months by Sheriff Tony Kelly.

Kennedy was shown mercy at a hearing today/yesterday by Sheriff Kelly who was convinced to change the length and time of the tag.

Graham Mann, defending, told the court that his client has been working 8am until 2pm for four days a week in the private sector since the order was imposed.

The lawyer stated that Kennedy used to do an 8pm until 8am shift with the void being currently filled by an agency worker after 2pm.

The lawyer said: “I appreciate that this is not a negotiation but she is a single woman who lives on her own with a mortgage and car finance.

“Her income has decreased which has almost been cut in half – the punishment has to be imposed.

“I am told that as soon as her work have someone to replace her [to do the 8pm until 8am shift], she will be in a position in that she might lose her job.”

Sheriff Kelly extended the restriction of liberty order from six months to eight months with times of 10am and 7am on weekdays.

Kennedy, of the city’s Millerston, will remain indoors between 10pm and 7am at weekends.

The sheriff said: “The court is not usually interested in working around your arrangements but in the circumstances, I will agree to the approach.”
