The Crown Office and Procurator Fiscal Service (COPFS) has filed a First Notice to initiate the court process for a discretionary Fatal Accident Inquiry (FAI) into the death of David McClenaghan.
McClenaghan, a 57-year-old manager at Park’s Motor Group, passed away following a heart attack in his office at Park’s Kia Showroom in Coatbridge on August 26, 2018.
The purpose of a FAI is to determine the cause of death, the circumstances surrounding it, and to identify any reasonable precautions that could have been taken to prevent similar deaths in the future.
The FAI is expected to focus on the Scottish Ambulance Service’s actions and response to the emergency.
According to COPFS, FAIs are inquisitorial rather than accusatory, aiming to establish facts without assigning blame.
Procurator Fiscal Andy Shanks, who leads fatalities investigations for COPFS, stated, “The Lord Advocate considers that the death of David McClenaghan occurred in circumstances giving rise to serious public concern and as such a discretionary Fatal Accident Inquiry should be held.
“An FAI will allow a full public airing of the evidence of the procurator fiscal’s wider investigations with interested parties. The evidence will be tested in a public setting and be the subject of an independent judicial determination.”
A preliminary hearing is scheduled for September 9, 2024, at Airdrie Sheriff Court.
