PC Daniel Julian was the subject of a criminal trial in 2024 regarding the alleged sex attack in a hotel room in Kent in the early hours of August 17, 2021, which he denied.
He now faces misconduct proceedings, which began today, March 16, at Sussex Police Headquarters in Lewes.
The identity of the complainant is protected by law.
The panel heard that Julian was staying in the hotel for training when he sent a message to the complainant, referred to as PC Y, “falsely” claiming he “had forgotten his toothpaste”.
Robert Talalay, representative for the appropriate authority, said PC Y visited his room to bring him toothpaste, when he “grabbed her by the arm and tried to pull her into [his] room”.
He later asked PC Y if he could come to her room via text, Mr Talalay said, to which PC Y said “no”.
Julian then went to PC Y’s room between 1.17am and 1.20am “wearing only a towel” and “pushed into her room”, the panel heard, and allegedly subjected her to “a prolonged sexual assault”.
It was heard that Julian “pinned her to the wall” and the floor during the incident, which lasted around 40 minutes.
Mr Talalay added that PC Y was left with “bruises, scratches and reddening” after the incident.
He also said Julian “did not leave despite her stating approximately 50 times ‘no’ and asking him to leave”.
It was heard that PC Y’s phone fell under the bed during the incident and she pressed record on her camera.
The 16-minute recording was played to the panel, during which PC Y can be heard saying “no”, “please”, “I can’t” and “you’ve got to go” throughout. Both of them can also be heard laughing throughout.
Mr Talalay said: “[PC Y’s] account is he forced his way into her room, he pinned her against the wall.
“When she fell to the floor he pinned her against the floor.
“At one point his towel fell off. He pressed his penis against her.”
It was heard PC Y reported the incident formally in October 2021.
“He assaulted her, he sexually assaulted her,” Mr Talalay said.
“His actions in her room and refusing to leave after being told ‘no’ many times and being asked to leave many times were breaches of the standards of professional behaviour.”
The panel was shown PC Y’s police interview.
She said prior to the incident he invited her into his room after dinner and she declined before returning to her room.
While in her room, she received a message from Julian stating he had forgotten his toothpaste and she brought some to his room.
PC Y said: “He grabbed my arm and tried to pull me into his room.
“He took my arm and was stroking it. He said ‘come on, it will be fun, no one will ever know’.
“I said no.
“As I was going, he was shouting at me as I was walking down the corridor saying ‘come back’.”
She said he continued to text her after she returned to her room, saying he would “come to her room naked”, which she thought was “just a laugh”.
Julian eventually came to her room wearing just a towel, she said.
“He was like let me in and I said ‘no, it’s not happening’.
“I think I laughed a bit as well.
“He shoulder-barged me and ran at me and that was it. He was stronger and I flew.
“We hit the wall behind. He shut the door with one hand and one hand pinned this arm against the wall.
“That’s when I thought ‘this isn’t right’.
“He said ‘let me just lay on the bed… I won’t touch you’.
“He was trying to kiss my neck and I was moving.”
She said Julian then laid down on the bed and he asked her to lay down with her, which she refused.
She then said he “tried to push [her] onto the bed” but they fell to the floor.
“I remember hitting my back on the side of the bed,” she said.
“As we’ve fallen he’s fallen on top of me.
“He sat on top of me. He had his hands on my arms. I was laid out flat.
“He said ‘this is our chance’ and I kept saying ‘no’.
“He was completely naked. He kept trying to turn the lamp off.
“He tried to put his knee on my shoulder. I just couldn’t move.”
PC Y said she saw her phone under the bed and pressed record on her camera as she “thought he was going to rape [her] and no one was going to believe [her]”.
He then tried to pull her jogging bottoms down, PC Y said, and was “pressing his penis” on her.
“I was just scared… I just wanted it to stop,” she said.
“I just didn’t really know what else to do.”
PC Y said he “started talking about giving [her] a massage” and she said “no”, but he proceeded which she said “hurt”.
She said: “Some parts of it I was laughing, I have always been like it. If I’m scared or stressed… I wish I didn’t do it but I do.
“It was a nervous laugh. I didn’t know how to react.”
She said Julian also asked her to “show [him her] boob”, before he eventually left after she repeatedly asked him to.
The matters are allegedly in breach of the standards of professional behaviour in relation to honesty and integrity, discreditable conduct, authority, respect and courtesy.
The misconduct proceedings at Sussex Police Headquarters continue.
